Terms of Use
Effective date: April 2026

To the Artist — Your work doesn't end when the brush lifts. It begins when someone sees it.

To the Poet — You were the first to look at art and feel the need to answer. ekphra was made for that instinct.

To the Gallerist — You've always known that art needs a room. Here is one without walls.

To Everyone — Most of us are both. Artist and poet, maker and witness. ekphra is the room where those two finally meet.

1. Acceptance

By accessing or using ekphra.com, you agree to be bound by these Terms of Use. If you do not agree,please do not use this platform.

2. How Your Work Lives on ekphra — Consent and Use

This section forms part of your binding agreement with ekphra under Section 1 (Acceptance), and supplements the license granted in Section 3 (Display & Streaming Rights). By uploading content to any area of ekphra — including, without limitation, the Wall, your Artist page, your Poet page, your Gallery page, Ekphrasis, CoMural, and any feature introduced by ekphra in the future — you grant ekphra a non-exclusive, royalty-free, worldwide license to use your content in the following ways, at no additional cost or compensation beyond what is described in this section:

  • Your content may be viewed by other members and used as source material for original creative works, including ekphrasis poems, written in response to it by other members;
  • Your content, and any work created in response to it, may be displayed together across ekphra's public spaces, including the Ekphrasis feed and the Wall;
  • Your content may be featured in the Wall Hero banner, promotional placements, and any current or future marketing channel used to highlight ekphra and its members;
  • Your content may be streamed, displayed, or otherwise made available through ekphra Display, or any current or future ekphra service, to viewers worldwide.

This use of your work is core to ekphra's function as a platform connecting artists, poets, and gallerists, and is a condition of uploading content anywhere on the platform. If you do not agree to this use, do not upload content to ekphra.

Poems submitted to Ekphrasis are not required to include an image. Where a poet uploads their own image alongside a poem, that image is subject to the same terms described in this section.

Where a gallery account uploads work on behalf of a represented artist who does not hold an ekphra account, the gallery confirms, at the time of upload, that it has obtained that artist's permission for the work to be used in the ways described in this section. ekphra relies entirely on this confirmation and does not independently verify it. The gallery account is solely responsible for any claim, dispute, or liability arising from a lack of authorization from the represented artist, and agrees to indemnify and hold ekphra harmless from any such claim.

Preservation of derivative creative works. ekphra is not simply a hosting service — over time, the accumulated works, responses, and connections made on ekphra become a living record of the creative relationships between its artists and poets. This is central to what ekphra is. If you remove your content, ekphra will stop featuring it on your own page, on the Wall, in Wall Hero placements, and in new promotional use, within a reasonable processing period. However, where your content has already been used as the source material for a creative work by another member — such as an ekphrasis poem — both that derivative work and your original content will continue to be preserved and shown together, as they have become part of that shared record. This continues to apply even if you delete your account or leave the platform entirely. By uploading content to ekphra, you acknowledge and agree to this, and understand that your right to remove your content does not extend to removing another member's independent creative work made in response to it, or the original content preserved alongside it for that purpose.

Payment registration for revenue-generating use. ekphra is an evolving platform, and new revenue-generating services may be introduced over time as the platform grows. Any content you upload to ekphra — visual, audio, or otherwise, and regardless of where on the platform it is uploaded — may be used in ways that generate commercial revenue, including but not limited to ekphra Display (ekphra's subscription streaming service), subscriptions on your Poet page (such as the Reading Pass), content uploaded to Art Lab, Materials, and any other section of the platform, and any other current or future subscription, membership, licensing, or monetized feature ekphra may introduce. Where such use generates revenue, ekphra will pay that revenue automatically only to members who have completed Stripe account registration, and only for revenue generated from the date registration is completed onward. ekphra does not track, accrue, reserve, or retroactively pay revenue generated before a member's Stripe registration is completed, and bears no liability or obligation — financial or otherwise — for revenue generated during any period in which a member's Stripe registration is incomplete. This applies equally to all members regardless of account type, and to all content types and all ekphra services, whether existing today or introduced in the future.

You represent and warrant that you own the content you upload, or otherwise have the right to grant the license set out in this section, and that your content does not violate the copyright, privacy, or other rights of any third party. You agree to indemnify and hold ekphra harmless from any claims, damages, liabilities, or costs (including reasonable legal fees) arising from a breach of this representation.

3. Display & Streaming Rights

By uploading content to ekphra, you grant ekphra a non-exclusive, worldwide, royalty-free license to display, stream, reproduce, and make the uploaded content available through ekphra’s website, digital display channels, curated playlists, subscription displays, promotional materials, and related digital services.

This license does not transfer ownership of your work. You retain full copyright and may continue to use, sell, license, exhibit, or publish your work elsewhere.

If your uploaded content includes poetry, text, audio, images, or other collaborative material created by someone else, you are responsible for securing all necessary permissions from those contributors before uploading it to ekphra.

By uploading content to ekphra, you represent and warrant that you are the original creator of the work, or that you hold sufficient rights and authorization from the original creator to upload the work and to receive payments, royalties, or revenue on their behalf. ekphra does not independently verify authorship or rights ownership, and relies on this representation from every uploading account holder.

Where uploaded content generates commercial revenue through any current or future ekphra service — including but not limited to display, streaming, subscriptions, or derivative creative works produced by other members — that revenue will be shared with the uploading account holder in accordance with ekphra's then-published rate for that service. Any payments, royalties, revenue shares, or other distributions made by ekphra will be paid only to theuploading account holder. The uploading account holder is responsible for any private arrangements or paymentsto collaborators, including poets, writers, performers, or other contributors.

ekphra may calculate royalty or revenue distributions based on subscription revenue, display activity, streaming records, platform policies, and available payment methods. Payments may be subject to minimum payout thresholds, processing schedules, and administrative review.

You may remove your uploaded content from ekphra. After removal, ekphra will stop future display streaming of that content within a reasonable processing period.

4. Original Work Only

You may only submit work that you have created yourself or have explicit permission to share. Submitting work that belongs to others without permission is strictly prohibited and may result in immediate removal and account termination.

5. Community Standards & Curation

ekphra is a curated creative platform built for artists and poets. It is not a general-purpose image hosting or publishing service. By uploading content to ekphra, you acknowledge that this platform maintains active curation and that your work exists within a community held to shared standards of conduct and creative integrity.

The Wall is ekphra's primary public space — the first thing visitors encounter. Works displayed here are expected to meet a basic standard of image quality and artistic presentation. This includes photographs of artwork that are clearly lit, appropriately framed, and representative of the work as it actually exists. The ekphra curation team reviews Wall submissions and reserves the right to make any work privately visible where it does not meet these standards. Where reasonably possible, we will contact the artist by email to discuss the matter and invite re-upload. We will make every reasonable effort to communicate, but are not obligated to provide advance notice before taking action.

Ekphrasis is the poet's space — open, unfiltered, and intentionally free. It exists for raw responses to visual art: a single line, an unfinished thought, a poem in any language, from any voice. No quality standard is applied to poetry in Ekphrasis beyond basic community conduct. Ekphrasis is where the unpolished belongs, and we mean that sincerely.

Across all spaces on ekphra, the following are not permitted:

  • Harassment, hate speech, or content that discriminates on the basis of race, ethnicity, gender, religion, sexual orientation, disability, or national origin
  • Spam, unsolicited promotional content, or coordinated inauthentic behaviour
  • Sexually explicit content submitted without appropriate content labelling
  • Impersonation of another artist, poet, individual, or organization
  • Submission of work created by or belonging to another person without their explicit permission
  • Content designed to deceive, defraud, or cause harm to other members of the community

Violations of these standards may result in content removal, account suspension, or permanent termination, at ekphra's sole discretion. ekphra is not a neutral platform — it is a space with values, and those values will be upheld.

6. ekphra Shop

ekphra is a space built by artists, for artists.

When you buy on ekphra, you are buying directly from the artist — not from ekphra. ekphra provides the platform. The transaction is entirely between the buyer and the seller.

Each seller runs their shop their own way. Policies on returns, exchanges, and shipping are set by the individual seller. Seller policies take precedence. All sales are final by default unless a seller's shop policy states otherwise.

Please read each seller's shop policy carefully before purchasing.

ekphra believes in artistic freedom — and that extends to how each seller chooses to run their business. We welcome diverse approaches to shop policies, pricing, and the seller-buyer relationship. Every shop on ekphra is an expression of the artist behind it.

ekphra is not a party to any transaction between buyers and sellers. ekphra bears no liability for the accuracy of listings, the condition of items received, shipping delays, or any disputes arising between buyers and sellers.

In the event of a dispute, we encourage both parties to communicate directly and in good faith. The ekphra team may assist in mediation where possible, but is under no obligation to do so and cannot guarantee any resolution.

Messages exchanged through ekphra’s shop and marketplace systems are generally private between buyers and sellers. However, ekphra reserves the right to review communications where reasonably necessary for safety, fraud prevention, dispute resolution, moderation, legal compliance, or enforcement of these Terms.

Commission & Payment Processing — Full Transparency

When a sale is made, Stripe's payment processing fee (2.9% + CAD $0.30 per transaction) is deducted from the total first. The remaining amount is then split: 85% to the artist, 15% to ekphra.

Example: A $100 sale → Stripe deducts $3.20 → $96.80 remaining → Artist receives $82.28 · ekphra receives $14.52.

Artists on Stripe receive their earnings directly and automatically. Artists using Wise (countries where Stripe is unavailable) are paid within 30 days of sale. ekphra does not hold or manage artist funds in the Stripe model.

Sellers are responsible for complying with all applicable laws regarding the sale of goods, including taxes, export restrictions, and consumer protection requirements in their jurisdiction.

ekphra reserves the right to remove any listing or suspend any seller account that violates community standards or these terms.

We look forward to seeing how each artist shapes their shop — in design, policy, and spirit. This is your space to grow.

7. Content Labelling

Content labels — Open, Mature, and Raw — are assigned by the artist at the time of upload. ekphra respects artistic autonomy and does not curate based on content rating.

However, ekphra reserves the right to reassign content labels where a work appears significantly mislabelled, in order to protect the safety of our community and uphold the spirit of ekphra as a space where art and poetry can coexist with care and integrity.

8. Platform Rights & Curatorial Authority

ekphra reserves the right to remove, hide, reassign, or restrict access to any content at any time, at our sole discretion, without prior notice, where that content does not meet our community standards, curatorial guidelines, or the terms set out in this document.

This includes, but is not limited to:

  • Artwork photographs that are poorly lit, heavily cropped, significantly blurred, or otherwise fail to represent the work faithfully
  • Works whose image quality falls below the standard expected for a curated art platform
  • Content that violates community standards, regardless of how it is labelled
  • Content that poses legal, reputational, or safety risks to ekphra or its community

Where a work is made privately visible rather than permanently deleted, ekphra will make reasonable efforts to notify the uploading member by email and invite a conversation about re-upload or improvement. This communication is our intention wherever possible — it is not a contractual obligation, and we cannot guarantee it in every case.

A member whose content has been removed or made private may contact ekphra at hello@ekphra.com to discuss the matter. ekphra does not permanently close the door — we close it when necessary, and we do so in the interest of the space we are building together with our community.

ekphra does not edit, alter, or modify uploaded artwork without the explicit consent of the uploading member. Where an image appears to misrepresent a work, we will request that the member re-upload rather than make changes ourselves.

Account suspension or permanent termination may occur where these terms are seriously or repeatedly violated. In cases of termination, ekphra is not obligated to retain or return any uploaded content.

These rights exist not to limit artistic freedom, but to protect the integrity of a space that many artists and poets trust. We exercise them with care, and we take that responsibility seriously.

ekphra is provided as-is. We make no warranties regarding the availability, accuracy, or fitness for a particular purpose of this platform. Use at your own risk.
